Addictions Counseling Agreement

PROGRAM ARTICULATION AGREEMENT
between
Anne Arundel Community College and Salisbury University
Associate of Applied Science Degree in Addictions Counseling
to Bachelor of Science in Social Work
August 2019 through August 2024 

This Program Articulation Agreement (“Agreement”), dated this 20th day of April 2020, is by and between Anne Arundel Community College, a community college located in Arnold, Maryland, and Salisbury University, a constituent institution of the University System of Maryland (collectively, the “Parties” or “Institutions”). This Agreement sets forth the joint curricula and program requirements for the completion of the Associate of Applied Science in Addictions Counseling from Anne Arundel Community College and the Bachelor of Science in Social Work at Salisbury University.

RECITALS 

Whereas, Anne Arundel Community College and Salisbury University are committed to aligning curriculum to the expand educational opportunities and collaborative academic programming of their respective institutions; and

Whereas, the two Institutions are committed to providing a smooth transition for students wishing to earn an associate degree and a baccalaureate degree; and

Whereas, the intent of the Institutions is to avoid duplication of curricula, where appropriate, within articulated programs of studies; and

Whereas, the Institutions agree that the educational growth of students and the economic development of the community is better served through cooperative educational planning and optimal utilization of community resources.

Therefore, this Agreement commits the Parties to full support of an articulation process to deliver coursework for students, resulting in the associate of applied science degree from Anne Arundel Community College and credit toward the Bachelor of Science in Social Work at Salisbury University. The Parties agree to the following:

I. ACADEMIC REQUIREMENTS

A. The Institutions agree to follow the joint program curriculum and course by course articulation delineated in Appendix 1, which is attached hereto and made a part of this Agreement.

B. Both Institutions will cooperate toward developing, disseminating, and presenting the articulated program information to students.

C. Students who have graduated from Anne Arundel Community College with an Associate degree of Applied Science in Addictions Counseling must first apply to Salisbury University. Once a completed admissions application is received, Anne Arundel Community College graduates who have completed their associate’s degree in Addictions Counseling, with a cumulative grade point average of 2.0 or higher will be granted admission to Salisbury University as a Social Work major.

D. All articulated course credits applied towards satisfying a Bachelor of Science in Social Work major requirements earned at Anne Arundel Community College with a C or better will be accepted for transfer according to the articulation matrix in Appendix 1.

E. Salisbury University shall provide a Checklist for students as a planning tool for completing necessary coursework required for the Bachelor of Science in Social Work major in Appendix 2, attached hereto and made a part of this Agreement.

F. Students intending to transfer to Salisbury University should apply for admission by the priority deadline for the semester for which they intend to enroll.

G. Students are subject to all specific policies pertaining to students admitted to the Salisbury University baccalaureate degree program in Bachelor of Science in Social Work.

II. TERM

A. The term of this Articulation Agreement commences as of the date set forth in the introductory paragraph of this Agreement. This Agreement is based on the present curricula contained in this document and its incorporated appendices, and is effective for a five-year period from August 2019 to August 2024.

B. Either party may terminate this Agreement with notice to the other Party, pursuant to Section III.G below. Upon termination or expiration of this Agreement, the Parties shall develop a process that will reasonably allow students admitted to and enrolled in joint programming to continue their studies. Any student who is enrolled at the time of termination shall be able to continue and during that time the obligations of the institutions shall continue if required. 

III. GENERAL PROVISIONS

A. Each Institution is responsible for the administration of its respective courses, including content, requirements, faculty and student services (to include, but not limited to, admissions, financial aid, class registration, etc.).

B. When enrolled in a Salisbury University course, the student is subject to all policies and procedures applicable to Salisbury University students. When enrolled in an Anne Arundel Community College course, a student is subject to all policies and procedures applicable to Anne Arundel Community College students. Additional joint policies and procedures may be adopted and implemented at the discretion of both Parties.

C. The Parties recognize that course scheduling beyond the associate’s degree level resides exclusively with Salisbury University and will be coordinated with Anne Arundel Community College by the designated Salisbury University representative.

D. The disclosure of information about individual students is limited by the federal Family Educational Rights and Privacy Act (FERPA). The Parties agree that release of student educational records to the other Party is conditioned upon the submission of a signed agreement by the student authorizing such release.

E. The Parties shall publicize this Articulation Agreement on their respective websites, and other materials as appropriate. Notwithstanding the foregoing, neither Party may use the names or marks of the other without the prior approval of the other Party.

F. The Parties shall inform students in their respective programs of the complementary program opportunities available at each other’s respective institution, support each other’s marketing efforts toward the same, and encourage such students to apply to programs consistent with an individual student’s interests.

G. Notwithstanding anything in this Agreement to the contrary, both Parties retain full authority over their respective courses, programs, and requirements. Both Parties reserve the right to make changes to their respective courses, programs, and requirements. However, each Party shall give to the other reasonable notice and details of changes to this articulation Agreement and other changes in its courses, programs, and requirements that may affect this Agreement. Further, neither Party will terminate this Agreement at a time that would deter a “cohort-in-progress” from completing graduation within the originally designated timeframe.

I. The designated representatives shall meet as needed, at a mutually agreeable time and location, to discuss various collaborations and other topics of interest to either Institution. A Party may change its representative by giving notice to the other party.

J. Either institution may at any time recommend changes to this Agreement. Both Institutions reserve the right to modify the programs as deemed necessary and agree to inform the appropriate representatives of the other Institution of recommended changes. This Agreement may be modified only by a writing signed by both parties.

K. All notices under this Agreement must be in writing; delivered in person, by U.S. mail or by email.

L. Nothing in this Agreement is intended to form a joint venture between the Parties. Nothing in this Agreement is intended to create rights or benefits for any person or entity other than the Parties.

M. This Agreement integrates the entire agreement of the Parties and supersedes any and all prior and/or contemporaneous agreements between the Parties, written or oral, with respect to the subject matter of this Agreement.

This Program Articulation Agreement (“Agreement”), dated this 18th day of August 2020, is by and between Anne Arundel Community College, a community college located in Arnold, Maryland, and Salisbury University, a constituent institution of the University System of Maryland (collectively, the “Parties” or “Institutions”). This Agreement sets forth the joint curricula and program requirements for the completion of the Associate of Applied Science in Entrepreneurship from Anne Arundel Community College and the Bachelor of Science in Management at Salisbury University.

RECITALS 

Whereas, Anne Arundel Community College and Salisbury University are committed to partnering to expand the educational opportunities and collaborative academic programming of their respective institutions; and 

Whereas, the two Institutions are committed to providing a smooth transition for students wishing to earn an associate of arts degree and a baccalaureate degree; and 

Whereas, the intent of the Institutions is to avoid duplication of curricula, where appropriate, within articulated programs of studies; and 

Whereas, the Institutions agree that the educational growth of students and the economic development of the community is better served through cooperative educational planning and optimal utilization of community resources.

Salisbury University will accept the credits earned at Anne Arundel Community College which satisfy the Bachelor of Fine Arts in Art, Graphic Design Track major requirements if the student has earned a grade of C or better in the courses eligible for transfer, as set forth in the Articulation Pathway set forth in Appendix 1.

E. Students intending to transfer to Salisbury University should apply for admission by the priority deadline for the semester for which they intend to enroll.

F. Students admitted to the Salisbury University baccalaureate degree program in Bachelor of Fine Arts in Art, Graphic Design Track are subject to the institution’s policies pertaining to students. 

II. TERM

A. The term of this Articulation Agreement commences as of the date set forth in the introductory paragraph of this Agreement. This Agreement is based on the present curricula contained in this document and its incorporated appendices, and is effective for a five-year period from September 2021 to August 2026, after which the Agreement will automatically renew for one-year periods unless terminated by one of the Parties.

B. Either party may terminate this Agreement with written notice to the other Party. Termination or expiration of this Agreement will not affect a student’s ability to continue and complete their studies.

A. Each Institution is responsible for the administration of its respective courses, including content, requirements, faculty and student services (to include, but not limited to, admissions, financial aid, class registration, etc.).

N. This Agreement shall be enforced only in a court of competent jurisdiction within the State of Maryland. This Agreement, and all claims arising out of or relating to this Agreement, whether sounding in contract, tort, or otherwise shall be governed in all respects by the laws of Maryland, without reference to its conflicts of law

O. This Agreement may be executed in any number of counterparts, each of which, when so executed and delivered, will be deemed an original, and all of which will constitute one and the same agreement. This Agreement may be executed electronically. If signing electronically, the signatory for each Party acknowledges and agrees that by physically signing and returning the signed Agreement electronically or applying an electronic signature, the signatory for each Party consents to signing this Agreement electronically with an intent to be bound by its terms. The signatory for each Party agrees that the electronic signature appearing on this Agreement is the same as a handwritten signature for purposes of validity, enforceability, and admissibility. The signatory for each Party understands that if the signatory does not wish to sign electronically, the signatory may print and sign this Agreement and return it to the other Party. A copy of the Agreement will be sent to the other Party after execution.

Whereas, the intent of the Institutions is to avoid duplication of curricula, where appropriate, within articulated programs of studies; and 

Whereas, the Institutions agree that the educational growth of students and the economic development of the community is better served through cooperative educational planning and optimal utilization of community resources. 

Therefore, this Agreement commits the Parties to full support of an articulation process to deliver coursework for students, resulting in the Associate of Arts in Visual Arts Transfer-Graphic and Web Design from Anne Arundel Community College and credit toward the Bachelor of Fine Arts in Art, Graphic Design Track at Salisbury University. The Parties agree to the following:

I. ACADEMIC REQUIREMENTS

A. The Institutions agree to follow the joint program curriculum and course-by-course articulation delineated in Appendix 1, which is attached hereto and made a part of this Agreement.

B. The Institutions will cooperate toward developing, disseminating, and presenting the articulated program information to students.

C. Students who have graduated from Anne Arundel Community College with an Associate of Arts in Visual Arts Transfer- Graphic and Web Design must first apply for admission to Salisbury University. Once a completed admissions application is received, Anne Arundel Community College graduates who have completed the associate’s degree in Visual Arts Transfer- Graphic and Web Design, with a cumulative grade point average of 2.0 or higher will be granted admission to Salisbury University as an Art, Graphic Design Track major.

D. Salisbury University will accept the credits earned at Anne Arundel Community College which satisfy the Bachelor of Fine Arts in Art, Graphic Design Track major requirements if the student has earned a grade of C or better in the courses eligible for transfer, as set forth in the Articulation Pathway set forth in Appendix 1.

E. Students intending to transfer to Salisbury University should apply for admission by the priority deadline for the semester for which they intend to enroll.

F. Students admitted to the Salisbury University baccalaureate degree program in Bachelor of Fine Arts in Art, Graphic Design Track are subject to the institution’s policies pertaining to students. 

II. TERM

A. The term of this Articulation Agreement commences as of the date set forth in the introductory paragraph of this Agreement. This Agreement is based on the present curricula contained in this document and its incorporated appendices, and is effective for a five-year period from September 2021 to August 2026, after which the Agreement will automatically renew for one-year periods unless terminated by one of the Parties.

B. Either party may terminate this Agreement with written notice to the other Party. Termination or expiration of this Agreement will not affect a student’s ability to continue and complete their studies.

III. GENERAL PROVISIONS

A. Each Institution is responsible for the administration of its respective courses, including content, requirements, faculty and student services (to include, but not limited to, admissions, financial aid, class registration, etc.).

B. When enrolled in a Salisbury University course, the student is subject to all policies and procedures applicable to Salisbury University students. When enrolled in an Anne Arundel Community College course, a student is subject to all policies and procedures applicable to Anne Arundel Community College students. Additional joint policies and procedures may be adopted and implemented at the discretion of both Parties.

C. The Parties recognize that course scheduling beyond the associate’s degree level resides exclusively with Salisbury University and will be coordinated with Anne Arundel Community College by the designated Salisbury University representative.

D. The disclosure of information about individual students is limited by the federal Family Educational Rights and Privacy Act (FERPA). The Parties agree that release of student educational records to the other Party is conditioned upon the submission of a signed agreement by the student authorizing such release, unless an exception to FERPA applies.

E. The Parties shall publicize this Articulation Agreement on their respective websites, and other materials as appropriate. Notwithstanding the foregoing, neither Party may use the names or marks of the other without the prior written approval of the other Party.

F. The Parties shall inform students in their respective programs of the complementary program opportunities available at each other’s respective Institution, support each other’s marketing efforts toward the same, and encourage such students to apply to programs consistent with an individual student’s interests.

G. Notwithstanding anything in this Agreement to the contrary, the Parties retain full authority over their respective courses, programs, and requirements, and reserve the right to make changes to their respective courses, programs, and requirements. However, each Party shall provide reasonable notice and details of any such changes in its courses, programs, and requirements that may affect this Agreement.

L. Nothing in this Agreement is intended to form a joint venture between the Parties. Nothing in this Agreement is intended to create rights or benefits for any person or entity other than the Parties.

N. This Agreement shall be enforced only in a court of competent jurisdiction within the State of Maryland. O. This Agreement may be executed in any number of counterparts, each of which, when so executed and delivered, will be deemed an original, and all of which will constitute one and the same agreement. This Agreement may be executed electronically. If signing electronically, the signatory for each Party acknowledges and agrees that by physically signing and returning the signed Agreement electronically or applying an electronic signature, the signatory for each Party consents to signing this Agreement electronically with an intent to be bound by its terms. The signatory for each Party agrees that the electronic signature appearing on this Agreement is the same as a handwritten signature for purposes of validity, enforceability, and admissibility. The signatory for each Party understands that if the signatory does not wish to sign electronically, the signatory may print and sign this Agreement and return it to the other Party. A copy of the Agreement will be sent to the other Party after execution.

This Program Articulation Agreement (“Agreement”), dated this 20th day of April 2020, is by and between Anne Arundel Community College, a community college located in Arnold, Maryland, and Salisbury University, a constituent institution of the University System of Maryland (collectively, the “Parties” or “Institutions”). This Agreement sets forth the joint curricula and program requirements for the completion of the Associate of Applied Science in Human Services from Anne Arundel Community College and the Bachelor of Science in Social Work at Salisbury University.

RECITALS

Whereas, Anne Arundel Community College and Salisbury University are committed to aligning curriculum to the expand educational opportunities and collaborative academic programming of their respective institutions; and

Whereas, the two Institutions are committed to providing a smooth transition for students wishing to earn an associate degree and a baccalaureate degree; and

Whereas, the intent of the Institutions is to avoid duplication of curricula, where appropriate, within articulated programs of studies; and

Whereas, the Institutions agree that the educational growth of students and the economic development of the community is better served through cooperative educational planning and optimal utilization of community resources.

Therefore, this Agreement commits the Parties to full support of an articulation process to deliver coursework for students, resulting in the associate of applied science degree in Human Services from Anne Arundel Community College and credit toward the Bachelor of Science in Social Work at Salisbury University. The Parties agree to the following:

E. Salisbury University shall provide a Checklist for students as a planning tool for completing necessary coursework required for the Bachelor of Science in Social Work major in Appendix 2, attached hereto and made a part of this Agreement.

F. Students intending to transfer to Salisbury University should apply for admission by the priority deadline for the semester for which they intend to enroll.

G. Students are subject to all specific policies pertaining to students admitted to the Salisbury University baccalaureate degree program in Bachelor of Science in Social Work.

This Articulation Agreement ("Agreement" or "Articulation Agreement") is entered between Anne Arundel Community College (hereafter referral to as "AACC"), a community college located in Anne Arundel County, Maryland, and Salisbury University (hereafter referred to as "SU" or "Salisbury University"), a comprehensive university located in Salisbury, Maryland (collectively "the Parties"). This Agreement is effective October 3, 2016 through October 2, 2021 unless terminated pursuant to the terms of this Agreement. The Parties agree to offer an articulated program leading to the award of an Associate in Applied Science ("A.A.S") in Medical Laboratory Technician and a Bachelor of Science ("8.S.") in Medical Laboratory Science ("MLS" or "the Program"). This Articulation Agreement will allow students from AACC to transfer up to 64 credits earned for the A.A.S. at AACC to SU, leading to the award of the B.S. in Medical Laboratory Science at SU. The Parties agree to the following terms:

  1. The purpose of this Agreement is for AACC students to be able to obtain a baccalaureate degree that would allow upward career mobility and greater earning potential. This Agreement provides a systematic plan for students to continue their higher education beyond the A.A.S. degree from AACC and is entered into to serve the instructional needs of AACC students and graduates and prospective SU students.

    There are three specific goals under this Agreement. First, this Articulation Agreement should facilitate a smooth transition from AACC's Medical Laboratory Technician Program to the B.S. Program in MLS at SU. AACC graduates will understand how SU transfers the credits they earn at AACC, as well as the changes in requirements that may permit more flexible scheduling once the student has been admitted to and enrolled at SU.

    This Agreement is a publication of a clear set of expectations for both institutions and programs. Making the Parties expectations clear to students and between institutions not only contributes to the first goal, but also allows institutions to work collaboratively to meet the needs of AACC graduates. This Articulation Agreement will need to be updated, revised and refined as instructional programs are revised. Each school agrees to notify the other in writing within 30 days of curriculum change and if necessary to initiate any necessary modifications to this Agreement.

    AACC encourages graduates to continue their educational pathway in the MLS for both personal and professional development, as well as career advancement in the profession. This Articulation Agreement facilitates students' successful achievement of credentials in the field.

  2. The Program is designed for graduates of the A.A.S. degree program in Medical Laboratory Technician at AACC. A maximum of 64 credit hours from AACC will be allowed toward fulfillment of the 120 credit hours required for baccalaureate completion at SU. The Agreement is applicable to the SU 2016 Fall admitted Students through August 24, 2021. Those admitted prior to Fall 2016 are covered under a prior agreement dated February 2, 2011 between AACC and SU.

  3. All courses meeting general education requirements at AACC will transfer to and satisfy the general education requirements of SU. AACC students must maintain a 3.0 cumulative grade point average in order to be eligible for transfer. All Medical Laboratory Technician ("MLT'') and general education courses must be completed with the grade of "C" or better. See Exhibit A - the Transfer Agreement which is made a part of this Agreement. The following courses must also be completed with a grade of "C" or better: (The AACC number is followed by the Salisbury University number in parenthesis):

    BIO 231/232 (BIOL 215/216)
    BIO 223 (BIOL 211)
    CHM 111/112 (CHEM 121/122)

  4. The maximum number of credits that will be accepted by SU toward degree requirements from nondirect classroom instruction, including College-Level Examination Program (CLEP), Advanced Placement (AP), and other nationally recognized standardized examination scores, is 60. Consultation with SU admissions, and all applicable policies including with the Maryland Higher Education Commission ("MHEC") policies is necessary for application of AP, CLEP, IB, other non-traditional credit policies. Tech Prep credits will not transfer. Credit awarded for experiential learning ("life experience") is not recognized by and is not transferable to SU.

  5. Admission to the SU MLS Program is a two-step process, which should commence in the student's third semester at AACC. The student must first apply and gain admission to SU. Second, the student must formally apply for admission to the SU MLS Program by submitting an application to SU for admission to the SU Baccalaureate program in MLS. The MLS Program admissions policy can be foW1d on the SU Department of Health Sciences website (http://www.salisbury.edu/healthsci/MEDTECH/welcome.html).

  6. While AACC and SU do not presently have a dual enrollment program, should one be agreed to, this Agreement will not preclude students from applying to and if they meet the criteria participation in the dual enrollment program. Those students would be subject to the policies of said program should they apply.

  7. AACC students who have completed the A.A.S. will be given every consideration for financial assistance and will be eligible to compete for academic scholarships at SU.

  8. AACC and SU agree to publicize this program. The Parties further agree to monitor the performance of this Agreement and to revise it as necessary. The Agreement may be terminated by either party for due cause and with one academic year's notice. Termination of the Agreement will affect any students currently enrolled at AACC in the Medical Laboratory Technician Program at the time of termination, and they shall not be able to transfer MLT credits as Credit Without Registration ("CWR") pursuant to the Transfer Agreement attached as Exhibit A.

  9. SU will establish a mechanism to provide general non-individualized information regarding successful progress and/or attrition for the AACC students enrolled as a result of this Agreement.

  10. Any changes in policies, rules, regulations and new developments shall be communicated between the University and AACC.

  11. Both Parties agree to maintain accreditation, and to notify the other Party of any significant change in its accreditation or licensure status within thirty (30) days of such change in writing.
  12. The Parties shall at all times under this Agreement comply with all Federal, State and local laws. In conformity with applicable Jaws, the University and AACC do not and will not discriminate against any employee or employment application or applicant for registration in the course of study on account of race, color, creed, ethnicity, religion, sex, age, marital status, sexual orientation, sexual identity, gender identity, genetic identity, national origin, political affiliation, physical or mental handicap, veteran status or any other legally protected class. The Parties agree to maintain the privacy and security of personally identifiable education records and health information and to prevent disclosure in compliance with Federal laws. The Parties agree to report any suspected child abuse and/or neglect in compliance with State law and University's policy. The Parties agree to follow their respective policies of nondiscrimination based on Title VI of the Civil Rights Act of 1964 Title IX of the Education Amendments of 1972, the Americans with Disabilities Act and other applicable Jaws.

  13. This Agreement shall remain in force and effect from the date of execution for five (5) years from the effective date.

  14. This Agreement shall only be modified in writing with the same formality as the original Agreement.

  15. The relationship between the Parties to this Agreement is that of independent contractors and is not to be in any manner construed to create an employment relationship between the University, AACC and/or the student. The relationship of the Parties to this Agreement to each other shall not be construed to constitute a partnership, joint venture or any other relationship, other than that of independent contractors. No Party hereto shall have the right to bind the other to any agreement with a third party or to incur any obligation or liability on behalf of another Party.

  16. This Agreement and its construction shall be governed by the laws of the State of Maryland, and any interpretation, claim or dispute arising out of this Agreement shall be filed in a Maryland court of competent jurisdiction.

  17. This Agreement, and its attachments, if any, constitutes the entire understanding between the Parties with respect to its subject matter and supersedes any and all prior or contemporaneous understandings and agreements, whether oral or written, and cannot be modified except by written agreement signed by both Parties.

  18. This Agreement may be signed in one or more counterparts, each of which shall be deemed an original and all of which, together, shall constitute one document. Original signatures delivered by means of facsimile or other electronic communication shall be considered to be original signatures.

  19. In the event of any conflict between the terms and conditions of this Agreement and any other document referencing or regarding the subject matter herein, the terms and conditions of this Agreement shall prevail. No waiver, alteration, or modification of the provisions in this Agreement shall be binding unless in writing and signed by both Parties. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision.

  20. This Agreement shall be binding upon, and shall inure to the benefit of, the Parties and their respective legal representatives, successors, and permitted assigns.

  21. No right or remedy conferred in this Agreement upon or reserved to the Parties is intended to be exclusive of any other right or remedy. Each and every right and remedy shall be cumulative and in addition to any other right or remedy provided in this Agreement. The failure by either Party to insist upon the strict observance or performance of any of the provisions of this Agreement or to exercise any right or remedy shall not impair any such right or remedy or be construed as a waiver or relinquishment with respect to subsequent defaults. This Agreement is not intended to confer any right or benefit upon, or permit enforcement of any provision by, anyone other than the Parties to this Agreement. Neither this Agreement nor any right, remedy, obligation or liability arising hereunder or by reason hereof shall be assignable by either Party without the prior written consent of the other Party.

Once a completed admissions application is received, Anne Arundel Community College graduates who have completed the associate’s degree in Public Health Professions – Public Health, with a cumulative grade point average of 2.0 or higher will be granted admission to Salisbury University as a Public Health major.

D. Salisbury University will accept the credits earned at Anne Arundel Community College which satisfy the Bachelor of Science in Public Health major requirements if the student has earned a grade of C or better in the courses eligible for transfer, as set forth in the Articulation Pathway set forth in Appendix 1.

E. Students intending to transfer to Salisbury University should apply for admission by the priority deadline for the semester for which they intend to enroll.

F. Students admitted to the Salisbury University baccalaureate degree program in Bachelor of Science in Public Health are subject to the institution’s policies pertaining to students.

II. TERM

A. The term of this Articulation Agreement commences as of the date set forth in the introductory paragraph of this Agreement. This Agreement is based on the present curricula contained in this document and its incorporated appendices, and is effective for a five-year period from August 2022 to August 2027, after which the Agreement will automatically renew for one-year periods unless terminated by one of the Parties.

B. Either Party may terminate this Agreement with written notice to the other Party. Termination or expiration of this Agreement will not affect a student’s ability to continue and complete their studies.

III. GENERAL PROVISIONS

A. Each Institution is responsible for the administration of its respective courses, including content, requirements, faculty and student services (to include, but not limited to, admissions, financial aid, class registration, etc.).

B. When enrolled in a Salisbury University course, the student is subject to all policies and procedures applicable to Salisbury University students. When enrolled in an Anne Arundel Community College course, a student is subject to all policies and procedures applicable to Anne Arundel Community College students. Additional joint policies and procedures may be adopted and implemented at the discretion of both Parties.

C. The Parties recognize that course scheduling beyond the associate’s degree level resides exclusively with Salisbury University and will be coordinated with Anne Arundel Community College by the designated Salisbury University representative.

D. The disclosure of information about individual students is limited by the federal Family Educational Rights and Privacy Act (FERPA). The Parties agree that release of student educational records to the other Party is conditioned upon the submission of a signed agreement by the student authorizing such release, unless an exception to FERPA applies.

E. The Parties shall publicize this Articulation Agreement on their respective websites, and other materials as appropriate. Notwithstanding the foregoing, neither Party may use the names or marks of the other without the prior written approval of the other Party.

F. The Parties shall inform students in their respective programs of the complementary program opportunities available at each other’s respective Institution, support each other’s marketing efforts toward the same, and encourage such students to apply to programs consistent with an individual student’s interests.

G. Notwithstanding anything in this Agreement to the contrary, the Parties retain full authority over their respective courses, programs, and requirements, and reserve the right to make changes to their respective courses, programs, and requirements. However, each Party shall provide reasonable notice and details of any such changes in its courses, programs, and requirements that may affect this Agreement.

I. The designated representatives shall meet as needed, at a mutually agreeable time and location, to discuss various collaborations and other topics of interest to either Institution. A Party may change its representative by giving notice to the other Party.

J. The Institutions may at any time recommend changes to this Agreement. The Institutions reserve the right to modify the programs as deemed necessary and agree to inform the appropriate representatives of the other Institution of recommended changes. This Agreement may be modified only by a writing signed by both Parties.

K. All notices under this Agreement must be in writing; delivered in person, by U.S. mail or by email. Notice shall be effective upon receipt to the person to whom it was addressed or three (3) days after notice was sent, whichever is earlier. Notices shall be provided to the individuals listed below. Either Party may change the notice address set forth in this Agreement by providing notice to the other Party.

L. Nothing in this Agreement is intended to form a joint venture between the Parties. Nothing in this Agreement is intended to create rights or benefits for any person or entity other than the Parties.

M. This Agreement integrates the entire agreement of the Parties and supersedes any and all prior and/or contemporaneous agreements between the Parties, written or oral, with respect to the subject matter of this Agreement.

N. This Agreement shall be enforced only in a court of competent jurisdiction within the State of Maryland. This Agreement, and all claims arising out of or relating to this Agreement, whether sounding in contract, tort, or otherwise shall be governed in all respects by the laws of Maryland, without reference to its conflicts of law

O. This Agreement may be executed in any number of counterparts, each of which, when so executed and delivered, will be deemed an original, and all of which will constitute one and the same agreement. This Agreement may be executed electronically. If signing electronically, the signatory for each Party acknowledges and agrees that by physically signing and returning the signed Agreement electronically or applying an electronic signature, the signatory for each Party consents to signing this Agreement electronically with an intent to be bound by its terms. The signatory for each Party agrees that the electronic signature appearing on this Agreement is the same as a handwritten signature for purposes of validity, enforceability, and admissibility. The signatory for each Party understands that if the signatory does not wish to sign electronically, the signatory may print and sign this Agreement and return it to the other Party. A copy of the Agreement will be sent to the other Party after execution.
